I'm not sure it is out of Disney. Disney own the rights, they are basically commissioned series. They said "here, Netflix, make these for us" in the same way that Universal made TIH, and Paramount made IM1, IM2, Thor and Cap:TFA

Yeah, but my point is that until Avengers, NONE of the MCU was under the Disney umbrella, because it was before disney bought Marvel, and until Disney did, Paramount was assumed to distribute Avengers. I don't see how this is any different

But they bought the whole thing wholesale. Marvel Studios and all the distribution rights that Paramount and Universal had(this last buys came in handy for the Phase 1 dvd/blu-ray boxsets.

You're forgetting Avatar, that this is the Marvel Cinematic Universe

all of those flicks and the tv shows are made under Marvel's banner first and foremost

it's why the films made under Marvel Knights, Punisher War Zone and Ghost Rider 2, are not within the MCU

Yeah and now Disney have decided that Netflix would be the best place for some TV shows, TV shows that would not fit on any Disney owned network, shows that they know would not make money through their own distribution methods, but shows that they none-the-less believed "should" be made and can make money through a service like Netflix,

I'm not quite sure what you are trying to say here :-\ TASM and X-Men have the Marvel banner but are not MCU, my point is that Disney own the rights, so whatever Netflix want to do with them, Disney have the final say, because they are still Disney owned properties. That cannot be said for Punisher or Ghost Rider (at the time those movies were made, I believe both have reverted to Marvel/Disney now)

The MCU is first and foremost a Disney property after they bought Marvel and the rights for their movies. I understand if Disney didn´t like to give the full benefits to a show that´s not in their conglomerate. That being said, since no such as the Marvel Knights label exists in the context of the MCU, and since Disney deals in lighter stuff, I guess outsourcing stuff like Daredevil to other entities is a nice bussiness oportunity.
